How Long You Have to File

Under Florida's current statute of limitations for negligence (Fla. Stat. §95.11), you generally have two years from the date of the crash to file a personal injury lawsuit, and two years from the date of death for a wrongful-death claim. This was shortened from four years by HB 837 in 2023, so the old "four-year" rule no longer applies. Claims involving a government entity carry additional pre-suit notice requirements under §768.28 that demand action much sooner. Waiting can permanently bar your right to recover.
