Quick answer: After a Florida motorcycle crash, call 911 and get a police report, then get medical care right away. Photograph the scene, the vehicle, and your gear; collect the driver's and witnesses' information; and don't admit fault or give the driver's insurer a recorded statement. Two things make motorcycle claims different: you have no PIP on the bike (so your own health insurance and UM coverage matter more), and you generally are not held to the serious-injury threshold before suing the at-fault driver. What to Do After a Motorcycle Accident in Florida

Motorcycle crashes tend to be serious, so your first priority is your health. If you're able, work through these steps:

  1. Call 911 and get a report. Wait for an officer so the crash is officially documented — a key piece of any claim.
  2. Accept medical evaluation. Road rash, fractures, and head injuries can be worse than they first feel. Let paramedics assess you and follow up quickly.
  3. Document the scene. Photos and video of the vehicle, plate, roadway, signals, your bike, your helmet, and your injuries.
  4. Gather information. The driver's license and insurance, and contact details for every witness — independent witnesses are especially valuable against rider bias.
  5. Guard your words. Don't apologize or speculate about fault, and don't give the driver's insurer a recorded statement before speaking with an attorney.
  6. Preserve your gear. Keep your helmet, jacket, and the motorcycle as they are; the damage tells the story of the impact.

Get Medical Care Right Away

Even without a PIP deadline (more on that below), prompt treatment protects both your health and your claim. The medical record created in the first days is what ties your injuries to the crash — and insurers pounce on any gap in care to argue you weren't really hurt. Serious motorcycle injuries often require trauma care, imaging, and surgery, so follow through on every referral.

Why Motorcyclists Have No PIP — and Why It Can Help

This is the single biggest way a motorcycle claim differs from a car or bicycle claim.

Motorcycles are excluded from no-fault: Florida's PIP law (Fla. Stat. §627.736) covers four-wheeled vehicles, not motorcycles. There is no PIP to pay your motorcycle-crash bills — you rely on your health insurance, any MedPay you carry, the at-fault driver's coverage, and your own UM/UIM. Our explainer on Florida PIP covers how no-fault works for cars.

There's an upside, though. Because you aren't covered by PIP on the bike, you generally are not subject to the serious-injury threshold that limits car-crash victims — so you may pursue the at-fault driver for pain and suffering without first proving a "permanent" injury. It's fact-specific, and one of the first things we evaluate.

What NOT to Do

Don't leave without a police report. It anchors the official version of events against later blame.

Don't assume a helmet issue ends your claim. Riders 21 and older may ride without a helmet if they carry $10,000 in medical benefits (Fla. Stat. §316.211). It does not decide who caused the crash.

Don't give a recorded statement to the driver's insurer before speaking with an attorney.

Don't accept a fast settlement before your injuries are fully known. Once you sign a release, the claim is closed.

How Injured Riders Get Paid

With no PIP and no requirement that Florida drivers carry bodily-injury liability coverage, your sources of recovery are:

  • The at-fault driver's liability insurance — the primary source when another driver caused the crash.
  • Your own UM/UIM coverage — often the key policy when the driver who hit you has little or no insurance.
  • Your health insurance or MedPay — to cover treatment while the claim is pursued.

We review every policy that could apply. Learn more on our Florida motorcycle accident page.

Fault, Rider Bias, and Your Deadline

Comparative negligence (Fla. Stat. §768.81): Your recovery is reduced by your share of fault, and under HB 837 anyone found more than 50% at fault recovers nothing. Insurers and even jurors sometimes start with a bias against riders, so how fault is established matters. See our explainer on Florida's comparative negligence rule.
Two-year deadline (Fla. Stat. §95.11): Most Florida motorcycle claims must be filed within two years (HB 837, effective March 24, 2023). See how long you have to file a motorcycle accident claim in Florida.

Florida Motorcycle Accident FAQ

Does my PIP cover me if I'm hurt on my motorcycle?

Generally no. Florida's PIP law applies to four-wheeled vehicles, not motorcycles, so you rely on health insurance, any MedPay, the at-fault driver's coverage, and your own UM/UIM.

Do I have to prove a "permanent" injury to sue the driver?

Often no. Because motorcycles are outside the no-fault system, riders generally are not held to the serious-injury threshold that limits car-crash victims — though the specifics depend on your case.

I wasn't wearing a helmet. Can I still recover?

Yes. Florida allows riders 21 and older to ride without a helmet if they carry $10,000 in medical benefits. The insurer may argue it affected your injuries, but it does not decide who caused the crash.

The driver who hit me had little or no insurance. Now what?

Your own uninsured/underinsured motorist (UM/UIM) coverage — and sometimes a resident relative's policy — may apply. For riders with no PIP, this coverage is often the key to a recovery.

How much does a motorcycle accident lawyer cost?

Nothing up front. We work on a contingency fee, so you pay a fee only if we recover compensation for you. The consultation is free and available 24/7.
