Quick answer: Yes — if you were hurt in a Lyft crash in Pompano Beach, you can almost always recover compensation. But "suing Lyft" usually means making a claim against Lyft's insurance, not holding Lyft responsible as the driver's employer. Florida's rideshare law (Fla. Stat. §627.748) blocks the usual "the company is liable for its driver" theory, because Lyft classifies drivers as independent contractors. The good news: when a Lyft driver is on a trip, Lyft's $1,000,000 policy applies. Free 24/7 review: (844) 877-8679.

Can You Actually Sue Lyft? The Honest Answer

This is the question we hear most from injured Pompano Beach riders, and the honest answer has two parts.

You can almost always recover after a Lyft crash — through Lyft's insurance, the driver's coverage, another driver's policy, or your own. What you usually cannot do is sue Lyft the way you would sue a trucking company for its employee's negligence.

Why (Fla. Stat. §627.748): Florida's transportation-network-company law treats Lyft drivers as independent contractors and forecloses the two easiest paths to the company — vicarious liability (holding Lyft responsible simply because its driver was negligent) and negligent hiring, training, or supervision. Any claim built only on "Lyft is responsible for its driver" fails under the statute.

That sounds discouraging, but it usually isn't — because the same statute requires Lyft to carry large insurance that pays your claim. Understanding which policy applies is where your recovery is won or lost.

Lyft's Insurance Depends on the App

Under Fla. Stat. §627.748, the coverage available turns on what the Lyft driver was doing in the app at the moment of the crash:

Phase 1 — app off: If the driver wasn't logged in, only the driver's personal auto policy applies. Lyft provides no coverage.
Phase 2 — logged in, waiting for a ride: Lyft carries contingent coverage of $50,000 per person / $100,000 per crash in bodily injury and $25,000 property damage.
Phase 3 — ride accepted, through drop-off: From the moment the driver heads to the pickup until you're dropped off, Lyft's full $1,000,000 policy is in force, plus uninsured/underinsured motorist coverage.

If you were a passenger, you were in Phase 3 — so the $1 million policy applies to your injuries. Adjusters sometimes try to characterize a Phase 3 crash as Phase 1 to shrink the payout, which is why we obtain the driver's app and trip data early. Who You Can Actually Recover From

A single Pompano Lyft crash can involve several sources of compensation:

  • Lyft's insurance policy — the $1M Phase 3 coverage (or the Phase 2 limits), which is the main source when the Lyft driver is at fault and you were a passenger.
  • The Lyft driver personally, through their own auto policy.
  • Another at-fault driver and that driver's insurer, if someone else caused the crash.
  • Your own coverage — PIP first, and your uninsured/underinsured motorist (UM/UIM) coverage if the at-fault party is underinsured.

When You Can Pursue Lyft Itself

Section 627.748 is not a total shield. In the right case, narrower theories can reach Lyft directly — not for the driver's negligence, but for Lyft's own conduct. These include claims that Lyft's app design encourages distracted driving, or that Lyft and its drivers operated as a joint venture. These are fact-intensive and depend on what Lyft's internal records show in discovery, so we evaluate them case by case rather than promising them up front.

Watch out for bad advice. If a source tells you that you can simply "sue Lyft because its driver was negligent," it hasn't accounted for §627.748. The right approach is to pursue Lyft's insurance and, where the facts support it, Lyft's own conduct — not a vicarious-liability theory the statute forecloses.

Pompano Beach Rideshare Crashes

Pompano's casino, beach, and interstate traffic keep Lyft and Uber vehicles busy day and night. The crashes we see cluster on I-95 and Florida's Turnpike at the Atlantic Boulevard, Copans Road, and Sample Road interchanges; on US-1 (Federal Highway) and Dixie Highway; and around the Isle Casino, the pier, and the A1A beach district, where late-night pickups raise the risk of impaired and distracted driving.

Serious injuries in the area are often treated at Broward Health North in nearby Deerfield Beach, and injury lawsuits are filed in the Seventeenth Judicial Circuit Court for Broward County in Fort Lauderdale.

PIP and the Injury Threshold

PIP first (Fla. Stat. §627.736): Your own PIP — or, if you don't own a car, PIP through the vehicle you were in or a resident relative — pays the first $10,000 of medical bills and lost wages if you treat within 14 days. To recover for pain and suffering beyond PIP, your injury must meet the serious-injury threshold (§627.737). See our guide to Florida's 14-day PIP rule.

Comparative Negligence

Modified comparative negligence (Fla. Stat. §768.81): Your recovery is reduced by your share of fault, and under HB 837 (effective March 24, 2023) anyone found more than 50% at fault recovers nothing. As a Lyft passenger you are almost never at fault, but if you were another driver or a pedestrian, expect the insurers to argue otherwise. See our explainer on Florida's comparative negligence rule.

The Two-Year Deadline

Two years. Under Fla. Stat. §95.11 — as shortened by HB 837, effective March 24, 2023 — most Florida rideshare claims must be filed within two years of the crash. But Lyft's app and trip data can be overwritten long before then, so acting early protects the evidence. More detail: Florida's 2026 statute of limitations update.

Pompano Beach Lyft Accident FAQ

Can I sue Lyft directly after a Pompano Beach crash?

Usually you recover from Lyft's insurance rather than by suing Lyft as the driver's employer — Fla. Stat. §627.748 forecloses that. Narrower theories based on Lyft's own conduct can sometimes reach the company directly, depending on the facts. We evaluate every serious case for those theories.

I was a passenger in a Lyft that crashed. Who pays?

Because the driver was on a trip, Lyft's $1,000,000 coverage generally applies, and as a passenger you are almost never at fault. Your own PIP still pays the first $10,000 of medical bills if you treat within 14 days.

What if the Lyft driver only had the app on but no passenger?

That's Phase 2 — Lyft's contingent coverage of $50,000 per person / $100,000 per crash applies on top of the driver's personal policy. The exact phase turns on the app data, which we obtain.

Does the same rule apply to Uber?

Yes. Uber and Lyft both operate under Florida's transportation-network-company law (§627.748), so the same coverage phases and the same limits on suing the company directly apply.

How much does a Pompano Beach rideshare accident lawyer cost?

Nothing up front. We work on a contingency fee, so you pay a fee only if we recover compensation for you. The consultation is free and available 24/7.
